Terms and Conditions (T&Cs)

§ 1 Scope and Provider

(1) These General Terms and Conditions apply to all orders and contracts between

(hereinafter "Provider")

and the customer (hereinafter "Customer") via the online shop https://bioyon.com.

(2) Deviating terms and conditions of the Customer are not recognized unless the Provider expressly agrees to their validity in writing.

§ 2 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) By clicking the "Order with obligation to pay" button, the Customer submits a binding offer to purchase the goods contained in the shopping cart.

(3) The contract is concluded when the Provider accepts the order through an order confirmation by e-mail or ships the goods. The automatic order confirmation does not yet constitute acceptance.

§ 3 Prices and Payment

(1) All stated prices are in Euro and include the statutory value-added tax, unless otherwise specified. Shipping costs, if applicable, will be displayed before completing the order.

(2) Payment is made using the payment methods offered in the order process: [Insert payment methods].

(3) The purchase price is due immediately upon conclusion of the contract, unless otherwise agreed.

§ 4 Delivery and Shipping

(1) Delivery will be made to the delivery address specified by the Customer within the delivery areas mentioned in the shop.

(2) Unless otherwise stated for the item, the delivery time is [X] working days after receipt of payment.

(3) If a product is not available, the Customer will be informed immediately; payments already made will be refunded.

§ 5 Retention of Title

The goods remain the property of the Provider until full payment has been received.

§ 6 Right of Withdrawal for Consumers

(1) Consumers have a statutory right of withdrawal of 14 days. Details can be found in the withdrawal policy in the shop.

(2) The right of withdrawal does not apply to goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery, or to goods that have been manufactured according to customer specifications.

§ 7 Warranty

(1) The statutory warranty rights apply.

(2) For entrepreneurs, the warranty period for new goods is 12 months from delivery, to the extent legally permissible.

§ 8 Liability

(1) The Provider is liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.

(2) In cases of slight negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract.

(3) Otherwise, liability is excluded. Liability under the Product Liability Act remains unaffected.

§ 9 Intended Use

The Customer undertakes to use the purchased products exclusively for their intended purpose and in compliance with all applicable legal provisions.

§ 10 Data Protection

Information on the processing of personal data can be found in the Provider's privacy policy.

§ 11 Dispute Resolution

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. The Provider is neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.

§ 12 Final Provisions

(1) Polish law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the mandatory consumer protection provisions of the state in which the consumer has their habitual residence.

(2) If the Customer is a merchant, the place of jurisdiction is Szczecin, Poland.

(3) Should individual provisions of these T&Cs be ineffective, the validity of the remaining provisions remains unaffected.
